Drug Possession in Florida

In the State of Florida, there are many different types of Drug crimes including possession, and/or trafficking in drugs. Depending on the drug and the amount of drugs, your charge may be a Misdemeanor or a Felony.

There are many alternatives to drug possession. These options include:

  1. Misdemeanor Diversion Program (MDP) or Pre-Trial Intervention (PTI)
  2. Pleas to a withhold adjudication (no conviction)
  3. Drug court
  4. Filing Motions to Suppress and/or dismiss
  5. Going to Trial, either by Judge or Jury.

It is imperative that you do not get a conviction on your record when charged with a drug crime. If you receive a drug conviction, the State of Florida will also suspend your driver license for a period of 2 years. Other consequences include fines, jail or prison time, probation, and/or community service.
